EVA TERMS OF SERVICE

ACCEPTANCE OF TERMS

By downloading, accessing, or using EVA, you agree to these Terms of Service.

SERVICE DESCRIPTION

EVA is a personal communication and location-sharing application that allows users to:

• Share location information

• Share recordings, photographs, and media

• Send notifications to trusted contacts

• Share status updates

• Manage personal communication preferences

EVA is a communication tool and is not a public safety service, emergency dispatch platform, government alert system, law enforcement service, medical service, or fire department.

USER RESPONSIBILITIES

Users agree to:

• Provide accurate account information

• Maintain account security

• Use EVA lawfully

• Obtain permission before adding trusted contacts

• Not misuse EVA services or communications

TRUSTED CONTACTS

Users represent that they have permission to provide trusted contact information.

Trusted contacts may receive notifications that include:

• User identity

• Location information voluntarily shared by the user

• Shared recordings, photographs, or media

• Status updates

• Links to information shared by the user

Trusted contacts must provide any required consent before receiving ongoing SMS notifications and may opt out at any time by replying STOP.

SMS TERMS

Participation in EVA's SMS messaging program is optional.

Providing a mobile phone number, creating an EVA account, or accepting these Terms does not automatically enroll a user in SMS messaging.

Users may opt in only by selecting a separate, optional, and initially unchecked SMS consent checkbox that describes the transactional SMS messages they may receive.

Users may create and use an EVA account without consenting to receive SMS messages.

Message frequency varies.

Message and data rates may apply.

Reply STOP to unsubscribe.

Reply HELP for assistance.

SMS consent is not required to create an account, use EVA, or make any purchase.

INTELLECTUAL PROPERTY

All EVA software, branding, trademarks, designs, content, and intellectual property remain the exclusive property of Nova Conscious LLC.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Nova Conscious LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of EVA.

TERMINATION

Nova Conscious LLC may suspend or terminate access to EVA for violations of these Terms.

CHANGES TO TERMS

Nova Conscious LLC may modify these Terms at any time. Continued use of EVA constitutes acceptance of any updated Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California.
